Informal Resolution First: Before initiating any formal legal proceeding, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.
Binding Arbitration: If informal resolution fails, you and Simply Put Ohio agree to resolve any dispute, claim, or controversy arising from or relating to these Terms or your use of the platform through binding arbitration administered by a mutually agreed neutral arbitrator in Ohio, rather than in court, except as set forth below.
Exceptions: Either party may seek emergency injunctive relief in court to prevent irreparable harm. Claims arising under intellectual property rights and small claims court matters (under $10,000) are excluded from this arbitration agreement.
Class Action Waiver: You agree that any arbitration shall be conducted on an individual basis only, and not as a class, consolidated, or representative action. You waive the right to participate in a class action lawsuit or class-wide arbitration.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. For matters excluded from arbitration, disputes arising under these Terms shall be resolved exclusively in the state or federal courts located in Stark County, Ohio.
Fraudulent activity, including fake job listings, scam marketplace listings, phishing attempts, and identity theft, is strictly prohibited and may be reported to law enforcement. Spam — including bulk posting, automated posting, and coordinated inauthentic behavior — is prohibited and may result in immediate account termination.
We may update these Terms from time to time. The "last updated" date at the top reflects the most recent revision. Continued use of the platform after changes constitutes acceptance of the updated Terms.
