These terms govern your use of the World of Goshen Community Recorder at simplyputohio.com (the "Service"), run by the World of Goshen game project ("we", "us"). By creating an account or uploading anything you agree to these Terms, our Privacy Policy and our Community Guidelines. If you do not agree, do not use the Service.

1. What the Service is for

The Service collects photos and videos of real places in the Michiana region (northern Indiana and southwest Michigan, including Goshen, Elkhart, South Bend, Mishawaka, Niles and the surrounding towns) so we can recreate streets, buildings and landmarks in the video game World of Goshen. It is not a social network: uploads are never shown publicly on this site.

2. Who may use it

You must be at least 13 years old. If you are under 18 you must have permission from a parent or legal guardian, who agrees to these Terms on your behalf. You may hold one account. Accounts are personal: keep your password secret and tell us at once through the contact form if you think someone else has used it.

3. Your uploads and the license you give us

You keep ownership of what you upload. By uploading you grant us a worldwide, non-exclusive, royalty-free, perpetual and irrevocable license to store, copy, review, edit, crop, combine, analyse and use your upload, and any location data you chose to share with it, to research, design, build, test, promote and update World of Goshen and related projects, including by creating in-game models, textures, layouts and other derivative works based on it. Derivative works we make (for example a building modelled from your photo) belong to us. We do not have to use, credit or keep any upload. If you delete an upload, we stop keeping the file itself, but anything already built from it may remain in the game.

You confirm that you took the photo or video yourself, or have the right to give us this license; that it does not infringe anyone's copyright, privacy or other rights; and that you followed the law and our Community Guidelines when you made it.

4. Review, moderation and removal

Every upload is checked automatically and then reviewed by a person before it is used. We may reject or remove any upload, at any time, for any reason, including anything that breaks the Guidelines. We do not pay for uploads.

5. Bans and account termination

We may suspend or permanently ban accounts, devices, browsers and internet (IP) addresses or address ranges that break these Terms or the Guidelines, attempt to get around limits or bans, upload abusive or illegal material, or put the Service or other people at risk. Bans may be applied without notice. Creating new accounts or using other devices or networks to get around a ban is itself a violation. You may delete your account at any time from the site.

6. Illegal content

Uploading sexual material involving minors, non-consensual intimate imagery, threats, or other illegal material is prohibited. We preserve and report such material to the National Center for Missing & Exploited Children and to law enforcement as the law requires, together with the account, device and connection information we hold.

7. Your safety

Never record while driving or riding a bike. Do not trespass, enter private property, or put yourself or others in danger to get footage. You are responsible for how and where you record.

8. Acceptable use of the Service

Do not attack, overload, scrape, reverse-engineer or probe the Service; do not use bots or automation to sign up or upload; do not upload malware or files disguised as photos or videos; do not impersonate anyone.

9. No warranty and limitation of liability

The Service is provided "as is" and "as available" without warranties of any kind. We may change, pause or shut it down at any time and may lose uploads. To the fullest extent the law allows, we are not liable for any indirect, incidental or consequential damages, or for any loss of data, arising from your use of the Service, and our total liability is limited to US $10.

10. Indemnity

You agree to cover our losses and costs if a claim is made against us because of something you uploaded or because you broke these Terms.

11. Changes

We may update these Terms. When we do, we change the version above and ask you to accept the new version before your next upload.

12. Law and contact

These Terms are governed by the laws of the State of Indiana, USA, and disputes go to the state or federal courts in Elkhart County, Indiana, unless the law where you live says otherwise. Questions, takedown requests and legal notices: use the contact form.
